The Constitutional Court rejects CNT’s internal rules

The National Transitional Council (CNT) will meet on Wednesday, December 23, after being beaten on the fingers.

National Transitional Council, the legislature for the Malian transition, was installed earlier this month, after weeks of intense controversy over its composition and an alleged “grip” by the military, according to its opponents. Work had finally begun with the adoption of this regulation, but in a judgment published on Monday, December 21, the Constitutional Court partially annulled it.

This did not invalidate the entire draft internal rules of the CNT, but three specific provisions.

First, the Court considers that the 121 members of the Transitional National Council are not entitled to the title “alternates”: even if they take up their duties, they were not elected. They should therefore be considered as mere “members” of the Council.

The draft Rules of Procedure also stipulate that the appointment of Quaestors, in particular the responsibility for drawing up the budget and practical matters relating to staff, premises or equipment, shall be made in the Council of Ministers and on a proposal from the President of the CNT; Colonel Malick Diaw, himself vice chairman of the CNSP junta, which led the military coup on 18 August. It is an “interference of the executive” in the legislation, still believe the judgments of the Constitutional Court, which specify that the Quaestors will have, like “the other members of the office, to be elected by their comrades”.

Finally, the Constitutional Court requests “improvements” and clarifications on the conditions for waiving the immunity of CNT members in the event of legal proceedings against them.

A new plenary session of the Transitional Council is scheduled for Wednesday. The ad hoc committee responsible for drafting the regulations must take these observations into account and submit a new version to the Constitutional Court.

A setback therefore, more than a dude. A member of the CNT, also an adviser to the junta, welcomes observations that are considered “minor” and that will be corrected “very quickly”. CNT will then finally be able to get to the bottom of it.
