South Africa’s Constitutional Court Halts Deportation of Asylum Seekers

The Constitutional Court has struck down portions of South Africa’s Refugees Act that empowered immigration officials to deport asylum seekers simply because they were in the country without a transit visa, calling those provisions unconstitutional.

The decision takes effect immediately and upholds a Western Cape High Court judgment handed down last year following a challenge brought by the Scalabrini Centre of Cape Town.
